Puppy Purchase Agreement

Silver Bullet Labradors (Seller) has agreed to sell and the below named (Buyer) has agreed to buy one AKC Registered Labrador Retriever Puppy for the Purchase Price named below, under the terms in this Agreement and described as follows:

PURCHASE PRICE 

The Purchase Price of the Puppy is $ $______________ with Limited AKC registration. 

$ ______________ with Full AKC registration. 

$2500.00 non-refundable deposit of the Purchase Price will be paid immediately with this Agreement as a Deposit to guarantee that Seller will hold the Puppy. 

The Balance Due ($______________), after crediting the Deposit ($250.00), will be paid. 

DEPOSIT TERMS: There are no refunds on Deposits, unless otherwise agreed here in writing. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for his possible loss. This deposit signifies the intent on the part of the Buyer to follow through with the Purchase of this Puppy. Buyer acknowledges that the Deposit is non-refundable in all circumstances, including but not limited to if Buyer decides s/he does not want or is no longer able to take the puppy. The Seller reserves the right to void this transaction and refund the Deposit if we learn of any reason why Buyer might not be suitable for the puppy –( i.e. Buyer is found to be a representative of a Pet Store, representative of a pharmaceutical research laboratory etc.). If the transaction is voided or if through some tragic accident the Puppy were to die or otherwise be seriously injured before it goes to its new home then, of course, the deposit will be returned to the Buyer; unless the Buyer wishes to apply the Deposit to another Puppy, if one is available, or to a puppy from the next available litter. 

NO PUPPY SHIPPING :

We do not ship puppies. Only available for local pick up. We can however give suggestions on puppy nannies if you are needing travel arrangements to pick up your pup.


OUR HEALTH GUARANTEE :

Puppy is free from life threatening diseases and disabilities, to the best of Breeders knowledge, for 72 hours after delivery to Buyer.  Should life threatening disease or disabilities, which cannot be rectified, be discovered by the Buyer within 72 hours of receipt of puppy, and attested to in writing to Breeder by Buyers licensed veterinarian, Breeder will provide Buyer with replacement puppy, or a full refund of purchase price if a puppy is no longer available.  Original puppy must be returned to Breeder before a replacement puppy or refund will be provided.  Transportation and veterinarian fees are the sole responsibility of the Buyer.  Viral, bacterial colds, Kennel Cough or parasite infections such as Coccidia or Giardia (bloody stools) which are easily treated are not covered in the health guarantee as they are natural things puppies can pick up. Umbilical Hernias also referred to as “outie” belly buttons, Entropion, and Cryptorchidism are not covered in the heath guarantee as they are treatable. Prior to pickup, Buyer will be made aware of any health issues that are present. Breeder will not cover the treatment cost for them. Puppies will be vet checked before going to their new homes, dew claws are removed, de-wormed and are given their age appropriate shots. All puppies are given socialization, love, and attention during their time with us. We believe that since we have chosen to bring our puppies into the world, it is our duty to provide the best we can for them. With this understanding in mind, we are now putting our trust in you to provide for their overall wellbeing for the lifetime of the dog. If at any time in the dog’s life you can no longer care for him/her due to lifestyle changes, financial hardship, or other extenuating circumstances we agree to take back the dog into our care (AKC papers must be furnished and no financial refunds will be given). The seller shall not be responsible for any Veterinary/medical costs for the puppy/dog after it is in the buyer’s possession. The puppy/dog is transferred to the buyer as “healthy” and is not responsible for any injury incurred to the puppy after the time of sale. Puppy is NOT to undergo spay/neutering until AFTER 12 months of age, a certification of spay/neuter will be required.  We do not guarantee hip or elbow dysplasia. This is something puppies can get environmentally.  Breeder also reserves the right to have their veterinarian view any health records and perform their own radiologic examination. Transportation and veterinarian fees are the sole responsibility of Buyer, except in the case where Breeder elects to have their own Veterinarian complete a 2nd opinion. In this case Breeder will pay for the 2nd opinion radiology costs, however Buyer is responsible for transportation to Breeder’s veterinarian.The puppy will have been given all age appropriate shots, and deworming by the Breeder.  Buyer agrees to immunize the puppy against diseases after they receive the puppy.  Breeder will not be responsible for diseases contracted as a result of not immunizing the puppy with all veterinarian recommended vaccinations. Breeder recommends that Buyer purchase Pet Insurance the day puppy is brought home to help with any veterinary fees that the Buyer may incur. Buyer understands that any unforeseen circumstances can occur and veterinarian fees can be costly. Breeder will not pay for any veterinary fees. Buyer agrees to take on the responsibility of training the puppy.  It is natural for a puppy to bark, chew, bite, play, dig, jump and need to be potty trained.  It is the buyer’s responsibility to train and teach him/her how to act and to give them gentle consequences. Breeder is not a certified professional trainer.  For the most enjoyable experience with your new companion, Breeder strongly recommends that every puppy have professional obedience training. Breeder does not guarantee the temperament of puppy. We bred only from dogs that have demonstrated a great stable temperament. We take great pride in providing a secure, loving environment for our Puppies from birth and provide daily proper socialization. After Pick Up, the responsibility is on the Buyer to provide a good environment with proper socialization. It is the Buyer’s responsibility to keep the Puppy free from harm and bad interactions with other people, dogs and animals. Any negative exposure of the puppy to a bad experience with other dogs or people can cause lasting effects. Be gentle with your Puppy and use Positive Reinforcement (Praise him when he does “good” - ignore his mistakes, don’t be overly negative) to train him. Do NOT hit your puppy or do silly things like rub his nose in urine or feces “accidents”. We do not guarantee skin traits. Each Labrador is different and may possibly develop allergies and affect skin coat. It is recommended you take your puppy to the vet for evaluation. With diet change and possible environment change skin conditions can be treated and is the buyer’s responsibility. The Buyer agrees to continue providing regular socialization for the Puppy after the pup is fully vaccinated. The purchaser agrees to provide a safe environment. We do not consider a rope or chain tie out or letting the Puppy run wild to be safe or appropriate. The buyer agrees to keep the Puppy healthy, maintain and stay current with all puppy vaccinations, and provide periodic vet checks including an initial examination. Seller will provide Buyer with a puppy in good general health and that has no known physical defects. Deworming and first immunizations will have been completed and detailed in writing. It is generally recognized that intestinal parasites (worms etc) are common in puppies, and are a part of a puppy’s early development. We make every effort to prevent parasites. Often, however, the stress of change and travel can cause intestinal parasites to emerge. Buyer agrees to continue parasite testing and treatment (if necessary) with their veterinarian. Buyer agrees that he/she will take their puppy to their veterinarian within 3 days of receiving the Puppy for examination, testing for worms, treatment for worms and to schedule ongoing immunizations as recommended. If the purchaser’s veterinarian finds the puppy to be in poor health, the veterinarian’s written description of the problems must be provided, dated within 3 days of the date the Buyer received their puppy. With documentation by veterinarian, that is dated within 3 days of Buyer’s receipt of the Puppy, that shows serious untreatable infectious illness or genetic defect which is sufficiently serious in the opinion of two qualified veterinarians, at least one of whom is selected by the Seller, to warrant euthanization of the dog, Buyer will be refunded the price of the Puppy or given a replacement Puppy from the Seller’s next available litter. Transportation costs (if any) will not be refunded and are not included in this guarantee. Expenses of treatment, exams and tests are the financial responsibility of the Buyer. Failure to have the puppy examined by a vet within 3 days of the date the puppy is delivered to Buyer or if Buyer fails to provide required immunizations, treatment for deworming, will mean that this health guarantee will be void.


FIRST RIGHT OF REFUSAL :

Should the Buyer find they are unexpectedly in a circumstance where death or other loss prevents them from being able to properly care for the Puppy, Buyer agrees that they will be contacted first and given first rights to the Puppy. If the dog is to be sold, Seller will be given the right of first refusal. Buyer agrees that the Puppy will NOT under any circumstances be placed in a dog pound or rescue center. This provision is to ensure that the Puppy will not end up homeless or destroyed. Buyer may return the dog to Breeder at any time during its lifetime. A complete vaccination record, health history and behavioral information must be provided. Buyer will not be refunded any money nor will another puppy be sold to them. Breeder may re-sale the puppy after Buyer has returned it and Buyer will receive no monetary return from the sale.

GENERAL INFO:

This written Agreement contains all of the terms of this Puppy Deposit and Sales Agreement. No refunds will be given, all deposits are non-refundable and all sales are final. 


By signing below, both Breeder and buyer agree to the terms of this contract. Breeder’s obligations are limited to those stated in this contract.Failure to follow the above contract per each section will result in “A Breach of Contract” and shall make that section of the contract null and void, following disciplinary action. This contract applies only to the original Buyer and is NOT transferable. The buyer agrees to pay any and all court and attorney fees incurred while enforcing this contract. Any and all court and attorney fees is not responsibility of breeder.
